This website is managed by 3Speeds Parcel Delivery. The words (Our Services - About Us - Why Us) on all pages of the website refer 3Speeds
Please read these Terms of Service carefully before accessing and/or using our website online. By accessing or using any part of the site, you agree to comply with these terms of service. If you do not agree to all the terms and conditions of this agreement, then we advise against using any of the services on the site. If the terms of service are presented as an offer, then acceptance is limited to these terms of service.
The terms and conditions agreed upon between Three Speed and the client related to transportation clarify the responsibility of Three Speed for any loss, damage, delay, incorrect delivery, non-delivery, and what happens to the shipment during its transport.
1- Definitions
Shipping Company: Thre Speed for Transportation and its agents. As the service provider.
Shipment: Means a piece or group of pieces, whether packages or shipments transported under a single shipping bill.
Shipping Bill: It is the transportation document (service contract), whether paper or electronic, which includes details of the shipment and terms and conditions of transportation.
Client: The party that has contracted with the shipping company to deliver goods from the pick-up location to the delivery location, and is responsible for paying fees and costs under this agreement.
Declared Value of Transportation: It is the value of the shipment disclosed by the sender, which estimates the service provider's liability for damage, loss, or delays.
Volumetric Weight (Dimensions): It is the length of the package × its height × its width (in centimeters) divided by 5000.
2- Modifications to the service or prices
If the selected service or entered weight is incorrect, Thre Speed has the right to make appropriate corrections on the shipping invoice and/or make appropriate adjustments on the bill at any time. Thre Speed also has the right to charge handling fees for making such corrections and adjustments to (the customer).
Our service rates are subject to change with notification to our customers. We reserve the right at any time to modify or suspend the service (or any part of it), and we will not be responsible towards you or any third party for any modification or change in price or suspension or termination of the service
3- Rejection of Shipments
Tharees Speed has the full right to reject any shipment, stop it, cancel it, postpone it, or return it at any time, if it is likely to cause damage or delay to the shipments, goods, or other people, or if its transportation is prohibited by law, or if it violates these conditions
4- Accuracy of Billing and Account Information
We reserve the right to refuse any service request you place with us. We may, in our discretion, limit or cancel services purchased by a person or account or as requested. These limitations may include orders placed under the same account.
You agree to provide current, complete, and accurate information for your account for all purchases made on our portal. You agree to update your account information and other details, including your email address, so that we can complete your transactions and contact you when necessary
5- Invoices and Payment
All government fees (customs duties, value-added tax, withholding taxes, clearance fees, and any other additional fees), if applicable and not listed in the pricing schedule, will be settled immediately.
The customer is not allowed to deduct any amounts from the invoice total. In case the shipping company issues a notification to the customer, it must specify the amount in each notification until the full notification amount is withdrawn.
All transactions under this agreement with Three Speed must be settled within (30) days from the invoice date.
Any fees incurred by Three Speed in collecting previous amounts due, including lawyer fees, court expenses, and court costs, will be the responsibility of the customer and the customer hereby indemnifies Three Speed for these costs. In relation to any payments under this agreement.
The customer must ensure that the net amount received from Three Speed matches the amount issued by Three Speed and due from the customer. In this context, any bank transfer fees, credit card fees, taxes, or similar fees will be the customer's responsibility.
Three Speed will settle shipping and delivery charges against collection payments upon receipt (as agreed) and transfer will be made if available.
For undelivered shipments, regardless of any shipper instructions, the shipper will be responsible for all fees, costs, and expenses related to shipping the shipment, as well as costs incurred for re-shipping the shipment or storing the shipment until disposal.
Three Speed reserves the right to suspend any and all services to the customer if the due invoice to Three Speed is not paid. As long as the non-payment persists, the customer alone is responsible for the consequences of any actions taken by Three Speed according to this clause.
Payment is accepted via bank transfer
6- Errors and Inaccuracies
Sometimes there may be information on our website or in the services provided by our website that contain typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors or inaccuracies, and to change or update this information or cancel orders if any information for such service on any related website is inaccurate at any time without prior notice (even if you have already submitted your request).
7- Claim and Compensation Policy
The sender must submit all claims related to delay, damage (partial or total), shortage, loss, or incorrect delivery within a period not exceeding (30) days from the date of shipment.
(3 Speeds) must be notified of all claims related to damage (visible or hidden) within 48 hours after the delivery of the shipment, and the damage must be acknowledged in the delivery receipt when the customer receives the shipment.
The customer can submit a claim through any available channels that support (3 Speeds) customer service.
Processing all claims by (3 Speeds) requires 7 to 14 working days for execution unless further investigation is needed.
If the customer pays any undue amounts through (3 Speeds) services, the amount will be refunded within a period not exceeding (14) days from the date of discovery of the error.
The customer agrees that the maximum liability limit of (3 Speeds) for uninsured shipments is only 200 Saudi Riyals. This includes total or partial loss or incorrect delivery.
3 Speeds is not responsible for damage to fragile shipments by their nature.
3 Speeds is not responsible for shipments that are susceptible to damage due to specific storage conditions, a specific period of time, or improper packaging by the sender.
The customer is not entitled to claim that the shipment was delivered to the (3 Speeds) representative and not updated by the representative, and the status of the shipment in the system still shows (new request) and has not been reported within 24 hours or not signed by the representative upon receiving the shipment.
8. No Guarantees
Except as clearly stated in these terms, (3Speeds) does not provide any other explicit or implicit guarantees.
9- Confidentiality
This agreement and all negotiations and communications resulting from it, as well as all data exchanged pursuant thereto, shall be treated as strictly confidential. Disclosure of any of the information contained herein may be grounds for immediate termination upon providing reliable evidence of such
10- Additional charges
3Speeds reserves the right to estimate fuel charges and
other additional charges on the shipment without notifying the customer
11- Force Majeure
Except as expressly provided in this document, each party to this agreement will be excused from performance under the contract by the other party during any period of any force majeure event, including but not limited to (acts of god, weather, lack of fuel, riots, civil disturbances, strikes, work stoppages, maintenance delays due to the other party's inability despite due care, curfews, or other operational restrictions imposed by airports or local government authorities, or any other cause beyond the control of the party.
12- Client Responsibilities
As part of this agreement, the client is required to provide any information requested by Three Speed in a reasonable manner for the purpose of allowing Three Speed to fulfill its obligations under this agreement. The client alone is responsible for ensuring that the information provided to Three Speed is accurate and valid and complies with all applicable laws. If the client fails to provide Three Speed with such information, Three Speed will not be responsible for any liability or additional expenses arising from such actions, and the client will compensate Three Speed for any liability or expenses incurred, including attorney fees resulting from it.
13- Termination
The obligations and responsibilities of the parties incurring before the expiration date shall be in force to terminate this agreement for all purposes.
The terms of service shall remain effective until terminated by us. You may terminate these terms of service at any time by notifying us that you no longer wish to use our services, and any due amounts will be settled within 60 days from the date of termination.
If you fail to comply with any term or provision of these terms of service, we may terminate this agreement at any time without prior notice, and you shall remain responsible for any due amounts until the expiration date. and/or accordingly, you may be denied access to our services (or any portion of it).
14- Personal Information
Your submission of your personal information through the Three-Speed portal is dealt with according to our privacy policy. You can refer to our privacy policy to learn more.
15- Abandoned, neglected, or returned shipments
If the delivery of the shipment is not possible for any reason (inability to communicate with the customer, customer's lack of response, refusal to accept, or customer's failure to provide delivery instructions or ignoring receipt), then it is within the right of Thre Speed according to its own discretion to either return the shipment to the sender; or place the shipment; or dispose of the shipment or take any other action to serve its interest after 60 sixty days from the date of the shipment. The customer must also pay return fees or any additional fees in cases where the shipment is returned to them due to inability to deliver (for example, but not limited to, due to: the customer not paying any required fees on the shipment, customer refusal to accept, refusal by governmental authorities, incorrect address). 3 Speeds also has the right to withhold the shipment and not deliver it if there are financial obligations attached to it, whether return fees or others. The customer is also not entitled to claim proof of delivery of the shipment after 60 sixty days from the date of the shipment.
Materials that are not transportable (prohibited)-16
Prohibited, dangerous, or prohibited materials to trade religiously and legally include, but are not limited to:
1. Drugs and alcohol in all forms
2. Tradable financial tools such as money, currencies, and alloys (gold, silver, precious metals)
3. Live plants and animals
4. Pornographic materials, stimulants, and radioactive materials
5. Hazardous goods and flammable/chemical materials
6. Firearms, their parts, and explosives of all kinds
7. Publications and prohibited materials that contradict with Saudi traditions, morals, public ethics, regulations, and laws
8. Commercial documents such as checks, financial stocks, invoices, bonds, account books, credit cards, treasury bonds, documents, or seals for materials related to disputes, cases, or differences.
9. Illegal goods as defined by the exporting country, crossing points, importing country, or international law.
10. Materials susceptible to corruption due to heat
17-General provisions
We reserve the right to refuse service to any individual for any reason at any time.
We do not guarantee that your use of our services will be uninterrupted, secure, or error-free.
18- Validity
If any provision of these terms of service is determined to be illegal, invalid, or unenforceable, such provision must nonetheless be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these terms of service, and will not affect the validity and enforceability of any remaining provisions.
19- Governing Law/ Dispute Resolution
This agreement shall be interpreted, implemented, managed, and controlled in accordance with the laws of the Kingdom of Saudi Arabia.
Any disputes arising from this agreement shall be finally settled through arbitration to be held in the Kingdom of Saudi Arabia, and shall be interpreted, implemented, as well as any disputes arising from it settled, according to that. Any dispute arising from the application of this agreement and not resolved amicably shall be referred to the Board of Grievances for final settlement
20- Property Rights
All intellectual property rights for these services and all materials, images, and videos found in the application or on the website or on social media accounts belong fully to (Three Speed), and no one is allowed to reuse these materials, publish them, or quote them without referring to the management of (Three Speed) and obtaining approval for that.
21- Modification of Terms of Use
3Speeds has the right, at any time it deems appropriate, to modify any term of the present terms of user agreement or replace it, or change the service or application, or suspend or terminate them
